Prekäre Menschenrechtslage für Homosexuelle in Nepal

Zur Verhaftung von 39 Mitgliedern der nepalesischen Organisation Blue Diamond Society in Katmandu erklärt Philipp Braun, Sprecher des Lesben- und Schwulenverbandes (LSVD):

In den vergangenen Monaten kam es in Nepal zu zahlreichen Gewalttaten gegen Schwule und männliche Transvestiten, die in der nepalesischen Gesellschaft traditionell Metis genannt werden. Am 9. August wurden in Katmandu 39 Mitglieder der Blue Diamond Society, die sich vor allem in der HIV und AIDS-Präventionsarbeit für schwule Männer und Metis engagiert, wegen "Erregung öffentlichen Ärgernisses" (public offence) verhaftet. Sie werden seitdem ohne Nahrung und ohne Wasser festgehalten.

Das Vorgehen der nepalesischen Behörden widerspricht allen international verbindlichen Menschenrechtsstandards. Nepal ist Unterzeichnerstaat des Internationalen Paktes über zivile und politische Rechte, der eine Diskriminierung aufgrund der sexuellen Identität verbietet. Zudem hat sich Nepal im Frühjahr in der UN-Menschenrechtskommission und während des Nepal Development Forum verpflichtet, der Einhaltung von Menschenrechtsstandards größeres Gewicht zu geben.

Wir haben heute in einem Schreiben die nepalesiche Regierung aufgefordert, dafür Sorge zu tragen, dass die 39 Mitglieder der Blue Diamond Society unverzüglich freigelassen werden und alles zu tun, dass schwule Männer und Metis in Nepal vor weiteren Übergriffen und Gewalttaten geschützt werden. Es darf keine Straffreiheit für diejenigen geben, die Schwule und Metis vergewaltigen, misshandeln oder töten.

Wir rufen dazu auf, das angefügte Protestschreiben an die nepalesische Botschaft in Deutschland weiterzuleiten.

Dear Sir,

with extreme concern I am writing to you about the deteriorating situation of gay persons and Metis in Nepal. I am deeply concerned about the violation of the basic human rights and basic dignity of gay persons and Metis in Nepal. It saddens me that the police force has been responsible for most of the recent assaults against them or that the police let the perpetrators carry on with impunity by refusing to act on any of the matters that have been brought to their notice.

On August 9, 2004 the Nepalese police force has arrested 39 members of the Blue Diamond Society without any basis. The Blue Diamond Society does important work in the area of HIV and AIDS prevention.

Nepal is a signatory to the International Covenant on Civil and Political Rights and its optional protocols and those protocols have been invoked in the UN Comittee on Human Rights in the past, wherein it has held in the Toonen case that member states cannot have laws that discriminate against homosexuals. This spring, in the UN Commission on Human Rights and during the Nepal Development Forum made a commitment to more closely follow international human rights standards. The police force is acting in a manner that suggests that the Nepalese government has started a campaign of persecution against Metis and other homosexual persons. The very fact is that under the international laws the Nepalese police force acted illegally.

I therefore request your government to intervene and to ensure that the arrested members of Blue Diamond Society are released from custody immediately and that Blue Diamond Society is provided with security for its staff and personnel so that they can carry on their important and vital work.
